• 30 Day Rule
  You may apply to return to the U.S. from Canada with a valid form I-94 and without a visa if you meet each of the following criteria:
  1. You don't stay in Canada more than 30 days.
  2. You don't go to any country other than Canada.
  3. You don't apply for a visa at a U.S. consulate in Canada.
  4. You have a valid passport.
  5. Stamped in that passport is SOME KIND of visa (not necessarily for the same status which you hold now and not necessarily multiple entry) which may have expired, or have been used up, as long as it is not cancelled.
  6. You are not a citizen of Iran, Iraq, Syria, Libya, North Korea, Sudan or any other country which has been found to have been supporting terrorism by the Department of State.
  7. You have been maintaining a legal nonimmigrant status in the U.S.
  8. You are returning to the U.S. to resume that status.
  9. You are not otherwise inadmissible to the U.S.
